Proposal for cyber legislation submitted to Dutch Senate

Cbw (NIS2 Directive) 1 July 2026

The Dutch Senate is currently reviewing the Cyberbeveiligingswet (Cbw), which enacts the EU’s NIS2 Directive in the Netherlands, and the Critical Entities Resilience Act (Wwke), which enforces the European Critical Entities Resilience (CER) Directive. On Tuesday, 7 July, members of the Dutch Senate will vote on both bills. If approved, the laws are expected to take effect on 15 August 2026.

Organisations subject to these laws will face new obligations regarding digital and physical resilience. The Dutch government advises affected organisations to begin preparing now (Dutch) for these upcoming requirements.

Senate review process

On 2 June 2026, the Dutch Senate published reports on both bills: the report on the Cyberbeveiligingswet (Dutch) and the report on the Critical Entities Resilience Act (Dutch). Members of various political groups raised questions about implementation, supervision, and the impact on organisations. The government responded to these questions in a memorandum on the Cbw (Dutch) and another on the Wwke (Dutch). During the procedural meeting on 23 June 2026, 1 question remained unanswered but has since been addressed in a second memorandum (Dutch). With this, the written review of both bills is now complete.

Cyberbeveiligingswet (Cbw)

The Dutch implementation of the EU’s NIS2 Directive, known as the Cyberbeveiligingswet, establishes requirements for the digital resilience of approximately 8,000 organisations within the country. Organisations are responsible for determining whether they are subject to this legislation.

Critical Entities Resilience Act (Wwke)

The Critical Entities Resilience Act is known in Dutch as the Wet weerbaarheid kritieke entiteiten (Wwke). The Wwke will implement the EU’s CER Directive in the Netherlands. It aims to strengthen the resilience of organisations providing essential services to society.
